Summary

  • Termphin is free to use, for anything, including at work.
  • It connects to servers you choose. You are responsible for having the right to access them and for what you do once connected.
  • The app is provided as it is, without warranties. It talks to production systems, so keep backups and check what you run.
  • These terms are governed by Polish law, which does not take away the consumer rights your own country gives you.

1. These terms

These Terms of Service are an agreement between you and MikoĊ‚aj Badyl ("we", "us"), the publisher of the Termphin application ("Termphin", "the app"). By installing or using the app you accept them. If you do not accept them, do not use the app.

The Privacy Policy forms part of these terms.

If you installed Termphin from Google Play, Google's own terms apply to that distribution as well. Google is not a party to this agreement and is not responsible for the app.

2. Licence

We grant you a worldwide, non-exclusive, royalty-free, revocable licence to install and use Termphin on devices you own or control, for any purpose, personal or commercial. No payment is required and there are no in-app purchases.

You may not:

  • sell, sublicense or redistribute the app as your own
  • remove or alter its notices of authorship or licensing
  • reverse engineer it beyond what applicable law permits regardless of contract terms

The app includes third-party open source components, each under its own licence. Those licences govern those components and are listed in the app under Settings, About, Open source licenses. Nothing in this section overrides them.

3. Your servers, your responsibility

Termphin is a client. It connects wherever you tell it to. You are solely responsible for:

  • having authorisation to access every system you connect to. Accessing a computer system without authorisation is a criminal offence in most countries, including under Article 267 of the Polish Penal Code and equivalents elsewhere. Do not use Termphin for it.
  • what you run. Commands, snippets and file transfers execute on your server with your privileges. A command that destroys data destroys it. The app will not stop you and cannot undo it.
  • your credentials. Keys, passwords and passphrases are held on your device, so their safety depends on the security of that device, on your screen lock and on your app lock. We cannot recover them, because we do not have them.
  • your data. Keep your own backups. Do not rely on the app, or on any single device, as the only copy of anything.

4. Acceptable use

Do not use Termphin to break the law, to gain or attempt to gain unauthorised access to any system, to attack or disrupt infrastructure, or to interfere with the app's own security measures.

You must be old enough to enter into a binding agreement where you live, and in any case at least 16 years old.

5. The remote agent

Termphin can keep a session alive across disconnects by uploading a small helper program to the server you are connecting to and running it there under your account. This happens with your action and on your instruction. You are responsible for whether that is permitted on that server. The helper is open source; its source is at https://github.com/Termphin/termphin-agent.

6. No warranty

Termphin is provided "as is" and "as available", without any warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the app will be uninterrupted, error-free, compatible with any particular server or device, or that any defect will be fixed. You use it at your own risk, and on systems whose importance you are best placed to judge.

If you are a consumer, the statutory warranty rights you have under the law of your country of residence are not affected by this section.

7. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of data, loss of profits, business interruption, or damage to systems, arising out of or connected with your use of the app, even if we have been advised that such damage is possible.

Where liability cannot lawfully be excluded, it is limited to the amount you paid us for the app, which is zero.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under applicable law. If you are a consumer, your mandatory statutory rights are unaffected.

8. Availability and changes to the app

We may change, add or remove features, or stop publishing the app altogether, at any time. We are not obliged to maintain any particular feature. Since the app runs on your device and connects directly to your servers, a version already installed keeps working as long as it works with your systems.

9. Termination

You may stop using Termphin at any time by uninstalling it. We may terminate this licence if you materially breach these terms, in particular section 4. On termination you must stop using the app; the data on your device remains yours and is removed by uninstalling.

10. Changes to these terms

If these terms change, the date at the top changes with it, and the current version is published at https://termphin.dev/terms. Continuing to use the app after a change means you accept the new terms. If a change materially reduces your rights, we will announce it in the app before it takes effect.

11. Governing law and disputes

These terms are governed by the law of Poland, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you live, and you may bring proceedings in the courts of that country. For everyone else, the courts competent for our place of residence in Poland have exclusive jurisdiction.

Consumers in the EU may also use the European Commission's online dispute resolution platform, though we would rather you simply wrote to us first.

12. International users

Termphin is published from Poland and available worldwide. You are responsible for complying with the laws of your own country when you use it, including any laws on encryption software and any export controls that apply to you.

13. General

If any provision of these terms is found unenforceable, the rest stays in force, and the unenforceable provision applies to the maximum extent permitted. Our not enforcing a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between us about the app. You may not assign them; we may assign them to a successor that takes over the app, on the same terms.
